PRIVACY POLICY
This Personal Information Privacy Policy (the "Privacy Policy") applies to all information that online store "Svydis Ukraine" operated under domain name svydis.com.ua, may receive about the User when using website of the Online Store, programs and products of the Online Store.
1. DEFINITIONS
1.1 The following terms are used in this Privacy Policy:
1.1.1. "Administration of Online Store Website (the "Website Administration") means employees authorized to administer website, acting on behalf of Svydis Ukraine, who arrange for and/or perform processing of personal data, and also determine purposes of personal data processing, scope of personal data subject to processing, actions (operations) performed with personal data.
1.1.2. "Personal Data" means any information relating to to an identified or identifiable, directly or indirectly, natural person or legal entity (personal data subject).
1.1.3. "Processing of Personal Data" means any action (operation) or set of actions (operations) which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, accumulation, storage, updating (refreshing, amending), retrieval, use, transmission (dissemination or otherwise making available, access), depersonalization, blocking, erasure or destruction of personal data;
1.1.4. "Personal Data Confidentiality" means a requirement binding upon an Operator or any other individual or entity which received an access to personal data prohibiting disclosure thereof without consent of the personal data subject or if there is any other legal cause.
1.1.5. "Online Store Website User (the User)" means a person having access to the Website via Internet and using Website of the Online Store.
1.1.6. "Cookies" means a small piece of data sent by the Web server and stored at the user's computer, which Web client or Web browser sends to Web server each time in HTTP-request while attempting to open page of a respective website.
1.1.7. "IP address" means a unique network address of a node in the computer network built according to IP protocol.
2. GENERAL
2.1. The usage by the User of the Online Store Website means his/her consent to this Privacy Policy and terms and conditions of Processing of Personal Data.
2.2. If the User disagrees to the terms and condition of the Privacy Policy, he/she shall terminate usage of the Online Store Website.
2.3. This Privacy Policy applies only to Online Store Svydis Ukraine Website. Online Store does not control or bear liability for the third party websites where the User may go using the links available on the Online Store Website.
2.4. Website Administration does not check the authenticity of the Personal Data provided by the User of the Online Store Website.
3. SCOPE OF PRIVACY POLICY
3.1. This Privacy Policy establishes the obligations of the Website Administration of the Online Store to not disclose and ensure the regime for protecting the confidentiality of Personal Data that the User provides upon the request of the Website Administration when registering on the website of the Online Store or when making an order for the purchase of the Goods.
3.2. Personal Data authorized for processing under this Privacy Policy is provided by the User by filling out the registration form on Svydis Ukraine Online Store Website in the "Personal Account" section and includes the following information:
3.2.1. surname, name, patronymic of the User;
3.2.2. contact phone of the User;
3.2.3. e-mail address;
3.2.4. delivery address of the Goods;
3.2.5. physical address of the User;
3.2.6. registered address of the User (for legal entities).
3.3. The Online Store protects Data that is automatically transmitted during the viewing of ad units and when visiting pages on which the statistical script of the system is installed:
- IP address;
- information from cookies;
- information about the browser (or other program that provides access to the display of advertising);
- access time;
- address of the page on which the ad unit is located;
- referrer (address of the previous page).
3.3.1. Disabling cookies may result in inability to access parts of the Online Store that require authorization.
3.3.2. The Online Store collects statistics about the IP-addresses of its visitors. This information is used to troubleshoot and solve technical problems, to control the legality of financial payments.
3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is subject to secure storage and non-distribution, except as provided in Clauses 5.2. and 5.3. of this Privacy Policy.
4. PURPOSES OF THE USER'S PERSONAL INFORMATION COLLECTION
4.1. The Website Administration of the Online Store may use the User's Personal Data in order to:
4.1.1. Identify the User registered on the website of the Online Store for making an order and (or) entering into a Sales and Purchase Agreement with the company Svydis Ukraine by remote means.
4.1.2. Provide the User with access to the personalized resources of the Online Store Website.
4.1.3. Establish a feedback with the User, including sending notifications, inquiries regarding the use of the Online Store Website, render services, process requests and applications from the User.
4.1.4. Identify the location of the User to ensure security, prevent fraud.
4.1.5. Confirm the accuracy and completeness of the Personal Data provided by the User.
4.1.6. Create an account to make purchases, if the User has agreed to create an account.
4.1.7. Notify the User of the Online Store Website about the status of the Order.
4.1.8. Process and receive payments, confirm tax or tax benefits, challenge payments, determine the rights of the User to receive a loan facility.
4.1.9. Provide the User with effective customer and technical support in the event of problems related to the use of the Online Store Website.
4.1.10. Provide the User with product updates, special offers, price information, newsletters and other information with his/her consent on behalf of the Online Store or on behalf of the partners of the Online Store.
4.1.11. To carry out advertising activities with the consent of the User.
4.1.12. Provide the User with access to the websites or services of the partners of the Online Store in order to obtain products, updates and services.
5. METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING
5.1. Processing of Personal Data of the User is carried out without any time limit, in any legal way, including in personal data information systems using automation tools or without using such means.
5.2. The User agrees that the Website Administration has the right to transfer Personal Data to third parties, in particular, courier services, postal organizations, telecommunication operators, solely for the purpose of fulfilling the User's order issued on the Website of Svydis Ukraine Online Store, including the delivery of the Goods.
5.3. Personal Data of the User can be transferred to authorized government authorities of Ukraine only on the grounds and in the order established by the legislation of Ukraine.
5.4. In case of loss or disclosure of Personal Data, the Website Administration informs the User about the loss or disclosure of Personal Data.
5.5. The Website Administration takes necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.
5.6. The Website Administration together with the User takes all necessary measures to prevent losses or other negative consequences caused by loss or disclosure of the User's Personal Data.
6. OBLIGATIONS OF THE PARTIES
6.1. The User shall:
6.1.1. Provide the information on the Personal Data necessary for using the Online Store Website.
6.1.2. Update, complete the information provided on Personal Data in the event of a change in this information.
6.2. Website Administration shall:
6.2.1. Use the received information solely for the purposes specified in Clause 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept secret, not disclosed without prior written permission of the User, and also not sell, exchange, publish or disclose other Personal Data of the User, except for Clause 5.2. and Clause 5.3. of this Privacy Policy.
6.2.3. Take measures to protect the User's Personal Data Confidentiality in accordance with the procedure normally used to protect such information in the existing business.
6.2.4. Block Personal Data related to the relevant User immediately upon receiving an appeal or request from the User or his/her legal representative or authorized body for protection of rights of the personal data subjects for the verification period, in case of revealing unreliable Personal Data or illegal actions.
7. LIABILITY OF THE PARTIES
7.1. Website Administration that has not fulfilled its obligations is liable for losses incurred by the User due to the misuse of Personal Data, in accordance with the applicable laws of Ukraine, except for cases provided for in Clauses 5.2., 5.3. and 7.2. of this Privacy Policy.
7.2. In case of loss or disclosure of Confidential Information, the Website Administration is not responsible if this confidential information:
7.2.1. Has become publicly available prior to its loss or disclosure.
7.2.2. Has been received from a third party before it was received by the Website Administration.
7.2.3. Has been disclosed with the consent of the User.
8. DISPUTE RESOLUTION
8.1. Prior to filing a lawsuit with the court under disputes arising out of relations between the User of the Online Store Website and Website Administration, it is mandatory to lodge a complaint (a written proposal for the voluntary settlement of a dispute).
8.2 The claim recipient shall notify the claimer in writing about the results of the complaint review within 30 calendar days from the date of receiving thereof.
8.3. If the agreement is not reached, the dispute will be referred to the judicial authority in accordance with the applicable laws of Ukraine.
8.4. This Privacy Policy and relations between the User and the Website Administration shall be governed by the applicable laws of Ukraine.
9. ADDITIONAL CONDITIONS
9.1. The Website Administration has the right to amend this Privacy Policy without the consent of the User.
9.2. New Privacy Policy comes into effect immediately after it is posted on the Online Store Website, unless otherwise provided for in the new edition of the Privacy Policy.
